Agreement for Volunteering - Garden Education Programs

This volunteer agreement is specific to the participation in the Garden Education Program Volunteer Opportunities with Santa Barbara Public Library. Activities may include: weeding, watering, planting, mulching, harvesting, pruning, preparing garden beds, using common garden tools, and physical movement including but not limited to lifting, bending, squatting, and kneeling.

In consideration of volunteering with Teen Volunteer Program at Santa Barbara Public Library beginning on the:

Hold Harmless and Indemnification:  I do hereby for myself, and for my heirs, executors, administrators, successors and assignees, release, waive, and forever discharge the City and its officers, employees and agents from any and all claims, actions, damage, costs, judgments, or liability whatsoever, which I now have or which may hereafter accrue to me on account of or in any way growing out of any and all known and unknown, foreseen and unforeseen, bodily and personal injuries and property damage and the consequences thereof resulting from my participation in the Teen Volunteer Program. 

I understand that in signing this Agreement I am releasing the City from any and all claims that I may have for personal injuries or property damage that I may suffer as a result of participating in the above-described event, if such injuries or damage were caused by the negligence of willful misconduct of the City or its agents, officers, or employees. 

I further understand and agree that in signing this document all my rights under section 1542 of the Civil Code of California are also expressly waived. That section reads as follows: "A general release does not extend to claims which the creditor does not know or suspect to exist in his favor at the time of executing the release, which if know by him must have materially affected his settlement with the debtor." 

I, acknowledge that no representation of fact or opinion had been made by the City, or any of its officers, employees, or agents, to induce this release on my part and that I have signed this release freely and voluntarily, after having read it completely, and with full knowledge of any rights or privileges that I may be waiving or releasing. 

Work Commitment: I certify that I am capable of performing the duties set forth in the document and know of no physical condition which would preclude the performance of those duties. I agree to notify Library Staff if any such physical condition shall arise during the course of volunteering with Santa Barbara Public Library.
 
I agree that I will not use, possess, manufacture, dispense or distribute drugs or alcohol at any of our volunteer sites or do so prior to volunteering so that my performance is impaired. I agree to comply with rules, policies, and procedures of Santa Barbara Public Library. 

I have read and understand the City of Santa Barbara Code of Conduct. 

Statement of Confidentiality: I agree not to divulge any information regarding persons who are receiving services or other assistance from or who are volunteering or working for the Santa Barbara Public Library department. I understand Santa Barbara Public Library requirements and policy on observing confidentiality and my responsibility to follow this policy in my role as a volunteer. I recognize that unauthorized release of confidential information may make me subject to a criminal action under the provisions of the Welfare and Institutions Code, Section 10850, which states in part: "Except as otherwise provided in this section, no person shall publish or disclose or permit or cause to be published or disclosed any list of persons receiving public social services, no person shall publish, disclose, use or permit or cause to published, disclosed, or used, any confidential information pertaining to an applicant or recipient... Any of violation of this paragraph is a misdemeanor." I shall keep all transactions between Santa Barbara Public Library participants and staff or volunteers confidential. 

Media Release: Santa Barbara Public Library reserves the right to take and use photos of participants for publicity purposes free of charge. Photos of participants may be used in Santa Barbara Public Library promotional materials. I hereby grant the City of Santa Barbara permission for the free use of the volunteer's likeness, name, voice, and words in any broadcast, telecast, print media, or Internet media account of this event or activity. 

Grounds of Termination: I understand that my volunteer assignment may be terminated for grounds that include but are not limited to; completing responsibilities in an unacceptable manner, not fulfilling the time commitment or training requirements, abusing Santa Barbara Public Library rules or policies, exercising unsafe work practices, or excessively disrupting program participants or staff. A volunteer may be dismissed at any time. The City reserves the right to request that a volunteer leave immediately if circumstances warrant such actions.

City of Santa Barbara: Code of Conduct and Release Agreement

CODE OF CONDUCT By signing the release agreement below, you acknowledge that you have read and fully understand the City of Santa Barbara Public Library "Code of conduct” and do thereby for yourself or on behalf of your child(ren), agree to abide by its policies and conditions exactly as written. 
CITY OF SANTA BARBARA RELEASE AGREEMENT IN CONSIDERATION OF BEING PERMITTED TO PARTICIPATE IN THIS CITY ACTIVITY OR USE OF ANY CITY FACILITIES IN CONNECTION WITH THIS ACTIVITY, THE UNDERSIGNED AGREES TO THE FOLLOWING: 
1. THE UNDERSIGNED HEREBY RELEASES, WAIVES, DISCHARGES AND COVENANTS NOT TO SUE THE CITY OF SANTA BARBARA, ITS EMPLOYEES, OFFICERS AND AGENTS (hereinafter referred to as "releasees") from all liability to the undersigned, his or her personal representatives, assigns, heirs, and next of kin for any loss, damage, or claim therefore on account of Injury to the person or property of the undersigned, whether caused by any negligent act or omission of the releasees or otherwise while the undersigned is participating in the City activity or using any City facilities in connection with the activity. 2. THE UNDERSIGNED HEREBY AGREES TO INDEMNIFY AND HOLD HARMLESS the releasees from all liability, calms, demands, causes of action, charges, expenses, and attorney fees (including attorney fees to establish the releasee's right to Indemnity or incurred on appeal) resulting from involvement In this activity whether caused by any negligent act or omission of the releasees or otherwise. 
3. THE UNDERSIGNED HEREBY ASSUMES FULL RESPONSIBILITY FOR AND RISK OF BODILY INJURY, DEATH OR PROPERTY DAMAGE while upon City property or participating in the activity or using any City facilities and equipment whether caused by any negligent act or omission of releasees or otherwise. The undersigned expressly agrees that the foregoing release and waiver, Indemnity agreement and assumption of risk are intended to be as broad and inclusive as permitted by California law and that if any portion thereof be held Invalid, notwithstanding, the balance shall continue in full legal force and effect. 

I acknowledge that I have read the foregoing and that I am aware of the legal consequences of this agreement, Including that it prevents me from suing the City or its employees, agents, or officers if I am injured or damaged for any reason as a result of participation in this activity. I further acknowledge that no oral representations, statements or inducements have been made. IF THE PARTICIPANT IS A MINOR, HIS OR HER CUSTODIAL PARENT OR LEGAL GUARDIAN MUST READ AND EXECUTE THIS AGREEMENT. I hereby warrant that I am the legal guardian or custodial parent of who is a minor and agree, on my own and said minor's behalf to the terms and conditions of the foregoing agreement. 

The benefits of Santa Barbara Public Library programs are numerous – enhancing health and building strong families and healthy communities. To insure the quality of programs and public safety, we ask all program participants, staff, parents, spectators, coaches, and volunteers, to abide by this Code of Conduct 
All persons shall act with respect towards other persons; respect their privacy and personal safety. Physical or verbal abuse of any kind will not be tolerated. 
All persons shall treat public and private property and equipment with respect. Program rules and regulations shall be observed at all times. 
Any City representative responsible for officiating, supervising or otherwise operating a Santa Barbara Public Library program shall have authority to enforce the terms of this Code, as authorized by the Director of Santa Barbara Public Library, empowered by Municipal Code Section 15.16.220. Failure of any person to abide by the Code of Conduct will result in disciplinary action, including (but not limited to): 1) removal from the program area, 2) restriction in program participation and 3) suspension or expulsion from the program. Minors under the age of 18 are required to have a parent or legal guardian sign the program registration form. The Library Director shall review any expulsion or suspension longer than three days. Appeals of any expulsion or suspension shall be filed in writing with the Library director within seven (7) days of action. The decision of theLibrary director is final.

CODIGO DE CONDUCTA Al firmar el acuerdo de liberación a continuación, usted reconoce que ha leído y comprende completamente el "Código de conducta" del Departamento de la Biblioteca Pública de la Ciudad de Santa Bárbara y, por lo tanto, lo hace por usted mismo o en nombre de su (s) hijo (s) acepta cumplir con sus políticas y condiciones exactamente como están escritas. 
ACUERDO DE DESCARGO DE LA CIUDAD DE SANTA BÁRBARA CONSIDERANDO QUE SE LE PERMITE PARTICIPAR EN ESTA ACTIVIDAD DE LA CIUDAD O EL USO DE CUALQUIER INSTALACIÓN DE LA CIUDAD EN RELACIÓN CON ESTA ACTIVIDAD, EL FIRMANTE ACEPTA LO SIGUIENTE: 
1. POR LO PRESENTE, EL FIRMANTE LIBERA, RENUNCIA, DESCARGA Y GARANTIZA NO DEMANDAR LA CIUDAD DE SANTA BARBARA, SUS EMPLEADOS, OFICIOS, O AGENTES (en lo sucesivo denominado "Liberados") de toda responsabilidad al firmante, sus representantes personales, cesionarios, herederos y familiares por cualquier pérdida, daño o reclamación, por lo tanto, a causa de lesiones a la persona o propiedad del firmante, ya sea por un acto negligente u omisión de los "Liberados” o de otro modo mientras el abajo firmante esté participando en la actividad de la Ciudad o usando las instalaciones de la Ciudad en relación con la actividad. 
2. POR LO PRESENTE, EL FIRMANTE ACEPTA INDEMNIFICAR Y MANTENER A PAZ Y A SALVO los Liberados de todo responsabilidad, reclamos, demandas, causas de acción, cargos, gastos y honorarios de abogados (Incluyendo honorarlos de abogado para establecer (incluyendo los honorarios de los abogados para establecer el derecho a la Indemnización del liberado o Incurrido en una apelación) resultante de la participación en esta actividad, ya sea causada por un acto negligente u omisión de las liberaciones o de otro modo. 
3. POR LO PRESENTE, EL FIRMANTE ACEPTA RESPONSABILIDAD TOTAL POR Y RIESGO DE LESIONES CORPORALES, DAÑOS POR MUERTE O PROPIEDADES mientras se encuentra en la propiedad de la Ciudad o participando en la actividad o utilizando cualquier instalación y equipo de la Ciudad ya sea por un acto negligente u omisión de los Liberados u otros. El abajo firmante acepta expresamente que el acuerdo de exención y renuncia, el acuerdo de Indemnización y la asunción de riesgo anteriores son tan amplios e inclusivos como lo permite la ley de California y que, si alguna parte del mismo se considera Inválida, el saldo continuará en plena fuerza y efecto legal. 
Reconozco que he leído lo anterior y que estoy al tanto de las consecuencias legales de este acuerdo, incluso que me impide demandar a la Ciudad o a sus empleados, agentes u oficiales si, como resultado, estoy lesionado o dañado por cualquier motivo de participación en esta actividad. Además, reconozco que no se han hecho declaraciones orales, declaraciones o incentivos 


Los beneficios de los programas de la biblioteca pública son numerosos – mejorando la salud y construyendo familias fuertes y comunidades saludables. Para asegurar la calidad de los programas y la seguridad pública, pedimos a todos los participantes, personal, padres, espectadores, entrenadores y voluntarios del programa que cumplan con este Código de conducta: 
Todos actuarán con respeto hacia otras personas; Respeta su privacidad y seguridad personal. 
El abuso físico o verbal de cualquier tipo no será tolerado. 
Todas las personas tratarán propiedad y equipo público y privado con respeto. 
Las reglas y regulaciones del programa deberán ser observadas en todo momento. 
Cualquier representante de la Ciudad responsable de oficiar, supervisar u operar un programa de la biblioteca pública tendrá autoridad para hacer cumplir los términos de este Código, según lo autorizado por la Directora de la biblioteca pública, habilitado por el Código Municipal Sección 15.16.220. La falta de cualquier persona de cumplir con el Código de Conducta resultará en una acción disciplinaria, que incluye pero no se limita a): 1) desalojo del área del programa, 2) restricción en la participación en el programa y 3) suspensión a expulsión del programa. Los menores deben tener un padre o guardián legal que firme el formulario de registro del programa. La Directora de la biblioteca pública revisará cualquier expulsión o suspensión por más de tres días. Las apelaciones de cualquier expulsión o suspensión se presentarán por escrito a la directora de la biblioteca pública dentro de los siete (7) días posteriores a la acción. La decisión de la directora de la biblioteca pública es definitiva.
